Please read the following carefully before signing

As a condition to being granted the right to enter onto and use the former Deer Ridge Golf Club property (the “Property”), the undersigned agrees:

Entering onto and using the Property, without limitation including but not limited to the trails, bridges, club house facility, walkways, parking lot, stairs, and open space, and/or participating in any Activities (as defined) on the Property, carry with them the potential for serious injury, death or property loss from hazards including, without limitation slipping, falling, colliding with others; drowning; contracting an illness or disease, including but not limited to Coronavirus; being injured by other individuals, animals, reptiles, or by defects in equipment, grounds or facilities, whether the hazards are inherent in the Property or Activity; or caused by the active or passive negligence of the Property owner or Activity sponsor, or its employees, members, contractors, managers, staff, or others. Such “Activities” include, without limitation, walking, jogging, running, bicycling, exercising, walking an animal, and using any equipment on the Property, whether such Activities are supervised or unsupervised, or authorized or unauthorized. I acknowledge and assume the foregoing risks; and assume the risk of entering onto and using the Property and participating in such Activities.

I agree to this “Waiver and Release” freely on behalf of myself, my executors, administrators, heirs, next of kin, successors, and assigns:

(1) I waive, release, and discharge from any claims or liabilities for death, personal injury, or damages of any kind, which acts arise out of, or relate to, my entering onto or using the Property, these persons or entities: World Business Academy Sustainable Vision I, LLC; World Business Academy Limited; building, facilities or Property owners, sponsors, tenants, lessees, and the officers, directors, employees, representatives, and agents of the above;

(2) I agree not to sue the persons or entities mentioned above for the claims or liabilities I have waived, released, or discharged herein;

(3) I understand and agree that under no circumstances shall the persons or entities mentioned above have a duty to provide security guards or medical support to me or any other person using the Property, or participating in or observing Activities on the Property;

(4) I will indemnify, defend, and hold harmless the persons or entities mentioned above from any claims made or liabilities assessed against them as a result of my actions, or those of my guests or pets, and this includes attorney fees or costs incurred by them as a result of my actions.

(5) To the extent I am a parent: By signing below, I bind myself and all other assigns to this Waiver and Release on behalf of the below listed minor(s). I represent that I have the legal capacity and authority to act for and on behalf of the minor(s), and I agree to indemnify and hold harmless the persons and entities mentioned above for any claims or liabilities assessed against them because of any insufficiency of my legal capacity or authority to act for or on behalf of the minor(s) in the execution of this Waiver and Release.

(6) This agreement and its interpretation and enforceability shall be governed by the laws of the State of California. This agreement shall survive and remain in full force and effect after my or any minor(s)’ membership at the Property has been terminated or expired.

(7) I am 18 years or older and legally competent to sign this Waiver and Release.
